What Happens during Mediation?
During most mediation proceedings, the parties are not in the same room during the process. The mediator does not represent either party but merely serves as a messenger to relay information back and forth in order to reach a settlement. Mediation is a voluntary process but may be ordered by the court. However neither side is obligated to settle at mediation. Typically if the mediation does not result in a settlement, the parties then move forward with a hearing in court.
Your mediation session will last as long as you need it to and may even be split up into more than one visit. Even when it takes some time, however, mediation is significantly less time-consuming and expensive than taking divorce proceedings to court.
